IHSS Overtime and Workweek Rules at a High Level
Point to CDSS overtime and workweek program pages, then ask the county or Public Authority how those rules apply locally. No stale hour totals.
About 4 minutes to read. Based on CDSS and DHCS public program pages retrieved 2026-09-13. County offices apply these rules. Hourly rates, hour totals, and wait times are local and change.
Short answer
IHSS providers claim authorized time from the Notice of Action. Workweek and overtime rules exist at the state level and are applied locally. Read the CDSS program-requirements page, then ask your county or Public Authority how a workweek is counted and how overtime is claimed on this case. Do not use a memorized statewide figure.
Who decides
The county and the local employer of record apply workweek and overtime rules. The social worker authorizes tasks and hours. Medi-Cal still sits under eligibility. The State issues pay on accepted timesheets.
What to do next
Open the CDSS IHSS program-requirements page, read your notice, then ask the Public Authority how workweek and overtime apply to your provider type, including live-in if that is your situation.
Authorized hours come first
Before anyone talks about overtime, there is a notice. The Notice of Action lists the tasks and hours the county authorized. That is the work you may claim. A family schedule that is larger than the notice does not create overtime. It creates unpaid family help next to a paid list. If hours seem low is the case path for that gap. Workweek basics is the companion checklist. This page is the official-source frame: where CDSS publishes the rules, and why you still ask locally.
Companionship sitting is usually not an IHSS category you can stretch into extra paid time. See tasks versus companionship. Overtime questions are about how authorized, claimed time is counted across a workweek, not about turning the living room into a second notice.
Read the CDSS program-requirements page
The California Department of Social Services keeps a page on IHSS new program requirements, including overtime and workweek material. That is the statewide pointer this guide uses. Printed numbers on older trainings go stale. Neighbor-county rumors go stale. This page will not quote hour thresholds or wage amounts that will be wrong next year. Open the CDSS page, then ask the office that processes your timesheet how it applies here.
CDSS providers and your county IHSS office sit next to that requirements page. The Public Authority is often the practical door for “how do I claim this on the timesheet.” Write the answer into the folder.
Questions to take to the Public Authority
- How they define the workweek for IHSS providers in this county.
- When overtime applies, and how you claim it in ESP, telephone timesheets, or the app.
- Whether more than one recipient or more than one provider changes the count.
- Whether travel between recipients is treated as work time.
- What happens if claimed time is over the authorized amount.
- How live-in self-certification on SOC 2298 meets overtime claiming, if you live in the home.
Do not build a whiteboard of dollar figures from memory. Hourly rates are negotiated locally and change. Ask the current rate in the same conversation if you need it for household planning, then keep both answers with the notice. First paycheck also flags share of cost, which can change the warrant without saying anything about overtime.
Two providers and a changing roster
If siblings share authorized hours, ask how the county looks at each person’s week. Overlapping claims are a pay problem even when everyone is well meaning. A family provider switch is a reason to ask the overtime questions again for the new person. A move to another county can change the local employer of record. Ask the new office rather than carrying the old stub as a rule.
EVV is how the week is recorded
Many providers record time with EVV. If the portal is stuck, that is a who to call problem, not a reason to reconstruct overtime on a paper napkin. Live-in paths differ. Say whether you live in the home when you ask the workweek questions.
What this overview does not do
It does not coach unpaid-wage claims, small claims, or suing a recipient, county, or Public Authority. It does not promise backpay, a particular overtime outcome, or a timeline. It does not tell you to claim time the notice does not authorize. If you believe a timesheet was processed incorrectly, ask the county how to question that period through their ordinary process.
Keep authorized time going in the official method so ordinary pay can move while you get a local answer. The caregivers page and the families page keep provider rules and the recipient case in one path. If you want help preparing the Public Authority questions, ask for help. The county still applies the local rules.
Questions people ask
- Can I use a number I heard in orientation last year?
- Ask again. Written rules change, and counties apply them locally. The CDSS page and the office that accepts your timesheet are the sources that count.
- If I work more than the notice, is that automatically overtime?
- No. Time beyond authorized hours is not a self-approved increase. Overtime, when it applies, is still tied to program rules and accepted timesheets. Ask how those meet on your case.
- Do two providers change the overtime picture?
- They can. Ask the county how multiple providers or more than one recipient affect the provider’s week. Do not invent a combined chart at home.
- Is this page legal advice about unpaid wages?
- No. It points to official CDSS guidance and to the county. It does not coach labor claims, small claims, or suits against a recipient or Public Authority.
