Friends and Neighbors as IHSS Providers in California

CDSS allows friends and neighbors to enroll as individual providers. Here is the enrollment path and what the recipient still decides as employer.

Short answer
CDSS says IHSS providers may include friends and neighbors after they finish individual-provider enrollment. The recipient still hires, trains, supervises, and can fire that person. The State issues the payment for authorized time. There is no separate “friend waiver.”

The recipient chooses whom to hire. The county IHSS office and Medi-Cal decide authorized hours and whether the chosen person’s enrollment can be paid.

CDSS names friends and neighbors on purpose
The official provider pages list family members, friends, neighbors, and Public Authority registry providers in the same breath. That sentence is the rule. A friend who already shops for groceries, or a neighbor who can be there in the afternoon, does not need a different legal category to enroll. They need the same individual-provider file: orientation, SOC 426, SOC 846, a background check where required, and a way to record authorized time.
The recipient remains the employer. Friendship does not move hiring, training, or firing over to the county. It also does not move payment over to the family checking account. The State issues the provider check after enrollment and accepted timesheets. If a Medi-Cal share of cost applies, unpaid share of cost can still be deducted from that warrant.
How a friend enrolls
Ask the county Public Authority or IHSS office which orientation they use and which packet to return. The usual published order is:
- Provider orientation through the county or Public Authority
- SOC 426 with names that match the recipient’s case
- SOC 846, signed by that friend, not by someone else in the household
- A DOJ background check where required
- Setup for EVV and timesheets once the county says which method to use
The friend must be authorized to work in the United States. They must be able to provide the authorized care safely. Living next door does not skip live-in rules. Live-in status applies when the provider lives with the recipient and self-certifies on SOC 2298, which changes EVV steps. A neighbor who goes home at night is not a live-in provider just because they have a key.

- Does a friend need to be on the Public Authority registry first?
- No. A friend the recipient already knows can enroll as an individual provider. The registry is a way to find someone when the recipient does not have a person in mind.
- Is the background check optional because we trust them?
- Trust does not replace the published enrollment steps. Many providers complete a Department of Justice background check. Ask the county which steps apply to that person.
- Can a neighbor share the job with an adult child?
- Yes, if the recipient hires both and both finish enrollment. Authorized hours still come from the notice, not from a handshake schedule.
