Applying for IHSS While Medi-Cal Is Still Pending

Pending Medi-Cal is common, and it is not a loophole

Adult children often start Medi-Cal on BenefitsCal and hear that IHSS is the program that can pay a family caregiver. They then ask whether they must wait for a Medi-Cal approval letter before they walk into the IHSS office. The honest answer has two parts. Some counties will take the IHSS application while Medi-Cal is still pending. IHSS still cannot complete without that determination.

That is the same rule as the rest of eligibility. IHSS is a Medi-Cal home care program. How the two programs work together is the longer explanation. This page is only about the timing of the two applications.

Why a county might take IHSS early

An IHSS file has its own queue: application intake, SOC 873, assignment of a social worker, the home visit, and the Notice of Action. If the county will accept SOC 295 while Medi-Cal is pending, those IHSS steps can start instead of sitting behind a Medi-Cal notice. SOC 873 can also be in motion. Provider enrollment can start when you know who will give the care.

None of that authorizes paid hours. Authorization still waits for the Medi-Cal determination and the rest of the required pieces. Early filing is paperwork hygiene. It is not a way around Medi-Cal.

What you should not invent while you wait

Do not invent a statewide rule that every county must take IHSS first, or that no county will. Ask the county IHSS office. Do not invent a number of days Medi-Cal or IHSS must finish in. Timing varies by county. Your county office can tell you what is typical locally.

Do not invent income limits or a share-of-cost amount while Medi-Cal is pending. The county Medi-Cal office confirms whether a share of cost applies and the amount after they determine eligibility. Guessing from an old chart creates a false budget.

A practical split of work

1. Start or continue Medi-Cal on BenefitsCal or with the county, using the DHCS apply page if you need the official entry points.
2. Ask IHSS whether they will accept SOC 295 now.
3. If they will, submit SOC 295 and return SOC 873.
4. Ask how an adult child can be listed on both files.
5. Check BenefitsCal for Medi-Cal requests. Check IHSS for missing IHSS pages.
6. After Medi-Cal is determined, confirm IHSS has that fact on the file so the assessment can finish.

Using BenefitsCal for a parent covers the adult-child account questions. Keep copies of every upload. A pending reason on Medi-Cal is often a missing signature, a proof page, or a question the parent has not answered. An IHSS pending reason is often a blank SOC 873 or a wait for a worker. Fix the reason that belongs to that office.

After Medi-Cal is determined

When Medi-Cal is approved, tell the IHSS worker if they do not already see it. If a share of cost applies, ask both offices how it will affect an IHSS warrant later. If Medi-Cal is denied, IHSS cannot complete on that foundation. Ask Medi-Cal what the notice says and whether another application path applies. This site does not write appeal scripts.
