Can a Spouse Enroll as an IHSS Provider in California?

Families often hear that “anyone can enroll as an IHSS provider” and stop there. For a spouse, that sentence is incomplete. When a spouse can be paid is the payability explainer. This page is the enrollment path if the county says the sub-program can pay.
Personal Care Services Program (PCSP) generally does not allow a spouse to be the paid provider. CFCO (Community First Choice Option), IPO, or IHSS-Residual can allow payment after enrollment. “Can allow” is not “will pay for every household task.” An able, available spouse is often deemed willing to provide many services unpaid. Ask the social worker which tasks, if any, are payable to the spouse on this case.
Ask which sub-program is on the file first
Before you sit through orientation as a spouse expecting a warrant, ask the county IHSS office which funding sub-program applies. IHSS sub-programs names PCSP, CFCO, IPO, and Residual in plain language. The label is a county and Medi-Cal assignment. A website cannot recode the file.
If the case is PCSP, treat spouse pay as generally unavailable and decide whether another enrolled provider will give authorized care. If the case is CFCO, IPO, or Residual, continue with enrollment and still ask about deemed services.

- If I finish orientation, will I be paid as a spouse?
- Enrollment is necessary when the sub-program can pay. It does not override PCSP’s general unpaid rule for spouses, and it does not override deemed-services rules. Ask the county which tasks, if any, are payable to you.
- Can we enroll an adult child instead?
- The recipient may hire an enrolled adult child or another provider for authorized hours. That is often simpler than spouse pay. It does not automatically make the spouse a paid provider for the same tasks.
- We live together. Does SOC 2298 make spouse pay easier?
- SOC 2298 changes Electronic Visit Verification steps for a live-in provider. It does not create spouse payability. Live-in status and sub-program payability are different questions.
- Is a registered domestic partner treated as a spouse?
- Ask the county how they treat the relationship on the file. Do not assume a dating partner is a spouse, and do not assume a marriage always pays.
