Private Pay Home Care in California

Private pay is a contract, not a county notice

When an adult child hires help out of pocket, the agreement is with the worker or with a licensed home care organization. That contract sets the private hours, the private rate, and who is the employer for those hours. It is not the IHSS Notice of Action. The county does not have to match it.

Families use private pay when IHSS is still pending, when authorized hours do not cover nights, or when they want a licensed agency’s staffing while a family member remains the IHSS provider for listed tasks. Confirm the license before you share a key

California licenses Home Care Organizations through CDSS Home Care Services. The California Home Care Registry is this site’s directory of licensed agencies. Confirm the name on the license matches the name on the contract. A friendly neighbor who is not enrolled as an IHSS provider and is not working through a licensed organization is a different legal and tax situation. Ask the county and, if needed, a tax or employment professional. This page is not that advice.

Licensing is not a quality score and it is not an IHSS authorization. It is a public status you can check. If someone will not show a license number, pause.

Two calendars, two payers

IHSS timesheets follow the Notice of Action, EVV rules, and the county rate. Private hours follow the agency contract or the private agreement. Do not record private hours on an IHSS timesheet. Do not ask the State to pay a private overtime story the notice never authorized.

Sharing IHSS hours across providers is for splitting authorized IHSS time. It is not a license to merge a private agency week onto the same sheet. If you are the family IHSS provider and an agency also comes, write both schedules on paper so a social worker, if they ask, can see the split.

Public Authority list versus a licensed agency

The county Public Authority helps IHSS recipients find individual providers on a registry. Public Authority registry and finding a provider on the list explain that path. Those workers, once enrolled, are paid through IHSS for authorized tasks. A licensed Home Care Organization is a business you pay privately unless it has a separate arrangement the county recognizes. Ask before you assume.

If your parent wants you as the paid IHSS provider, enrollment is still the county path: orientation, SOC 426, the provider agreement, and a background check where required. Private agency work does not skip those steps for the IHSS hours.

What to ask an agency in the first call

• What is the Home Care Organization license number, and may we confirm it.
• Which tasks would be private pay, and which would stay on an IHSS notice if one exists.
• Who is the employer for the private aides, and who do we call at night.
• How do you handle a hospital discharge that might last only a few days.

Get the answers in writing. Compare settings on compare care options. If Medi-Cal and IHSS are still the long-term plan, keep that packet moving while the agency covers the next week. Helping a parent apply is that parallel track.

Private pay does not replace a Medi-Cal determination

Hiring help this week does not create IHSS hours. If you want the public program, start Medi-Cal and SOC 295. If a share of cost later appears on the IHSS warrant, that is a Medi-Cal fact, not an agency invoice error. Ask both desks.
