Working Full Time and Being an IHSS Provider for Your Child

A parent of a child on IHSS may be paid only under some sub-programs after enrollment. A job does not, by itself, block or approve Medi-Cal or IHSS.

Short answer

A parent of a child under 18 who wants to be the IHSS provider while also working a job has two separate questions. Payability depends on the child’s IHSS sub-program (PCSP generally unpaid; CFCO, IPO, or Residual can allow pay after enrollment under ACL 23-106), and WIC 12300(e) still limits paid work for a minor. A job does not automatically block or approve Medi-Cal. The Medi-Cal office applies income rules. IHSS does not bar other work by itself, but authorized hours still have to be provided.

Who decides

The county IHSS office and Medi-Cal decide the child’s eligibility, the sub-program, authorized tasks, and whether an enrolled parent can be paid. County Medi-Cal staff decide how a parent’s job income counts for Medi-Cal.

This is a children’s IHSS question, not the adult-child path

A parent of a child with a disability who already works and also wants to be the paid IHSS provider is standing in a different line from an adult child caring for a parent. CDSS publishes IHSS for children. When a parent can be paid for a minor is the payability page. This page is the working-parent situation: job, sub-program, and Medi-Cal myths in one household.

Start with the sub-program on the child’s case. Then enroll if that program can pay a parent. Then read what WIC 12300(e) still withholds. Then ask Medi-Cal how they count the job. Flattening those layers into “working parents cannot be paid” or “working parents are always paid” is how families plan around a file the county has not written.

PCSP, CFCO, IPO, Residual, and ACL 23-106

Personal Care Services Program generally does not allow a parent to be the paid provider for a minor. CFCO, IPO, or IHSS-Residual can allow parent pay after enrollment. ACL 23-106 is the CDSS All County Letter counties use for that change. “May be paid” still requires orientation, SOC 426, SOC 846, a background check where required, and authorization to work in the United States.

Ask the county which label is on this child’s file. A website cannot recode it. If the case is PCSP, treat parent pay as generally unavailable and ask whether another enrolled provider can give authorized care. If the case is CFCO, IPO, or Residual, continue enrollment and still read WIC 12300(e).

WIC 12300(e) still limits paid work for a minor

Even when the parent can be the paid provider, state law limits what a provider may be paid to do for a minor. Ordinary parenting is not converted into IHSS hours. Protective supervision for a child is only for the child’s functional limitations when the county authorizes it as IHSS, not routine childcare, and not a way to fill the hours you are away at a job. The social worker applies Functional Index Rankings and Hourly Task Guidelines to the child.

Describe what the child cannot safely do alone, and what help is above ordinary parenting. Bring that description to the assessment. Do not bring a requested hour total that matches your work shift. The county writes the notice.

A job does not automatically block or approve Medi-Cal

Common questions families ask include whether a full-time paycheck ends a child’s Medi-Cal, or whether IHSS parent-provider wages will. County Medi-Cal staff apply MAGI or non-MAGI rules. Live-in treatment of caregiver wages may differ. This page does not invent income limits, exclusion amounts, or a household budget. Ask the county Medi-Cal office. Live-in wages and MAGI is the live-in version of that caution.

Report what Medi-Cal asks for on applications and renewals. Do not hide a job. Do not hide IHSS wages. Ask how they want each shown. DHCS Medi-Cal is the coverage source.

Authorized hours still have to be provided

IHSS does not bar other employment by itself. If you are the hired provider, you still give the authorized help on the notice, or the recipient’s representative hires someone else for those hours. Workweek and overtime questions are local. Ask the county or Public Authority. The CDSS overtime page is statewide background, not a substitute for the local instruction.

If another relative, a friend, or a Public Authority registry provider will cover authorized time while you are at work, that person enrolls separately. Your job calendar does not enroll them.

Regional center services sit next to IHSS, not on top of it

Some children also have a Department of Developmental Services regional center case. Personal assistance through a regional center is a different program with a different application and different parent-provider rules. It does not replace IHSS, and IHSS does not replace it. Questions people ask

If I work full time, can I still be my child’s IHSS provider?
IHSS does not, by itself, bar other employment. You still have to provide the authorized help the child’s representative hired you to do. Workweek and overtime rules are local. Ask the county or Public Authority. Payability still depends on PCSP versus CFCO, IPO, or Residual.
Will my job income end the child’s Medi-Cal?

Is this the same as an adult child caring for a parent while working?

Does regional center funding replace IHSS if I work?
